Does a Section 8 notice have to be served by a process server?

There is no absolute legal requirement to use a process server, but doing so is strongly advisable. If a tenant later disputes that they received the notice, independent proof of service from a professional process server can be the difference between a possession claim succeeding or being thrown out on a technicality.

Why has Section 8 become more important?

Because Section 21, the old no-fault eviction route, was abolished in the private rented sector from 1 May 2026.
